Equipment rental conditions

1. Concepts

1.1. The lessor is AjaxDemo LTD with registry code 11506520 and address Keemia 4, 10616 Tallinn, Estonia

1.2. The e-mail address for the lessor is [email protected]

1.3. The Lessee is a legal or natural person with whom the Lessor has concluded an Agreement.

1.4. The parties are the Lessor and the Lessee

1.5. The Agreement is an Equipment Rental Agreement concluded between the Parties.

1.6. The period is the period of time specified in the Agreement, during which the Lessee has the right to keep and use the equipment.

1.7. The device is a device or other property rented from the Lessor to the Lessee under the Agreement.

2. General conditions

2.1. The contract is considered to have been concluded by making the payment through the rentster.ee environment. By making the payment, the lessee confirms that he has read and accepted the equipment rental conditions.

2.2. If the Lessee has not ordered the transport of the Equipment by parcel machine or courier service, installation or removal, the Lessor assumes that the equipment(s) will be picked up and returned to the address of the Lessor's location.

2.3. The Lessor has the right to refuse to issue the Equipment if the person who picked up the Equipment cannot be identified.

2.4. If, upon returning the equipment, it appears that the equipment has been damaged in the Tenant's possession or the Equipment has been returned incomplete, the Lessor submits a claim to the Tenant in the amount of the damage, and the compensation must be paid within 7 days.

2.5. The devices are delivered to the Lessee within the territory of the Republic of Estonia.

2.6. All disputes arising from the Agreement will be resolved through negotiations, in the case of failure of negotiations in Harju County Court.

2.7. The controller of personal data is Rentster Online OÜ, the authorized processor for making payments is Montonio Finance OÜ

2.8. The methods of delivery are parcel machines, courier service and the possibility of picking it up at the Lessor's address.

2.9. As payment methods, we offer payment by transfer, through Montonio Finance OÜ and on site in cash or by card. The settlement currency is Euro.

3. Tenant's confirmations when concluding the contract

3.1. By signing the contract, the lessee confirms that

3.1.1. he has familiarized himself with the rented Equipment and their technical data before concluding the Agreement;

3.1.2. he has been instructed by the Lessor to use the Equipment to the extent necessary and has all the necessary skills to use the Equipment properly;

3.1.3. he gives consent to the Lessor for the processing of his personal data to the extent necessary within the framework of the customer relationship;

3.1.4. he and the person acting on his behalf have the right to conclude the Agreement.

4. Responsibilities of the lessee

4.1. The lessee undertakes

4.1.1. return the Equipment no later than the end of the rental period,

4.1.2. to use the rented Equipment prudently and in accordance with the user manual and to do everything possible to prevent malfunctions and damage to the rented Equipment or the theft of the Equipment,

4.1.3. to compensate for damage caused by malfunctions or damage to the equipment as a result of his activities, as well as possible lost income.

4.1.4. not to give the Device into the possession or use of third parties without the prior written consent of the Lessor. Third parties are not considered employees of the Tenant, who are permanently used by the Tenant in their economic and professional activities,

4.1.5. to notify the Lessor immediately of any damage to the Device, partial or complete failure or destruction of the Device, as well as loss or theft of the Device, and to take measures at their own expense to prevent the damage from increasing.

4.1.6. to pay the rental fee for the use of the Device on time according to the invoices submitted by the Lessor,

4.1.7. not to take the Device out of the territory of the Republic of Estonia without the written consent of the Lessor,

4.1.8. return the Equipment clean and in the same level of complexity as when renting it

4.1.9. to compensate the damage caused to the Equipment in his possession at the first request of the Lessor within the term specified by the Lessor.

5. Obligations of the lessor

5.1. The lessor undertakes

5.1.1. hand over the equipment in working order and usable to the Lessee,

5.1.2. when processing the lessee's personal data, comply with the requirements set forth in the General Personal Data Protection Regulation (EU) 2016/679, the Personal Data Protection Act and other legislation that regulates the processing of personal data

6. Liability

6.1. The Lessee bears full unconditional responsibility for the preservation of the Equipment from the time the possession of the Equipment is taken over from the Lessor, while the risk of accidental destruction of the equipment is also transferred from the Lessor to the Lessee at the moment of the transfer of possession.

6.2. In the case of a legal entity Tenant, all members of the Tenant's management board as natural persons are jointly and severally responsible with the Tenant for the payment of invoices and claims submitted by the Lessor.

6.3. The lessor is not responsible for possible material damage caused by technical failure of the rented equipment.

6.4. The lessor is not responsible for the performance of the service of third parties, such as courier companies, for timely delivery, or for non-delivery.
